Question for site owners

Thanks everyone, quite flattering really :)

I would need check if we can use the logo in that way. Also would you want the text RDR2.org as well, or not? I am not fussed either way.

Then I would need to look at options how to get it done. I remember it being quite easy to setup printing t-shirts these days.

Cheers

Part of the issue is licensing.  Because Red Dead Redemption 2 is trademarked by R* in multiple jurisdictions, I imagine it's variants are as well.

Let's see...

http://tmsearch.uspto.gov/bin/gate.exe?f=doc&state=4806:3u2zdt.10.54

That's Take Two Interactive's filing for Red Dead Redemption, including tee shirts.  Now, with how Corporation friendly US law is, I suspect that if TTI wanted to challenge the use of RDR2.org, they'd be successful.  Copyright claims, especially related to IPs are very protective and have a lot of safeguards against derivative is similar sounding names.

Which isn't to say that it can't be done, but it may behoove anyone considering something similar to entertain only attempting to profit off of original content, like user posts or art (much of which is protected by fair use).

If trademarks are an issue, then maybe t-shirts with just the outlaw from the site logo.

I'd be fine with that.

But maybe there's someone at Take Two that can be contacted about it? Like, "Hey, I run a fan site of RDR fans called RDR2.org and want to make some shirts with our original logo and the name 'RDR2.org' in order to support our community. Would this be something Take Two and Rockstar Games would take issue with?"

A real quick search shows that Redbubble are selling GTA and RDR2 clothing.

https://www.redbubble.com/shop/?iaCode=u-tees&query=rdr2&ref=search_box

The website sells gear produced by independent designers and operate under a "fair use" policy where it comes to copyright.

https://help.redbubble.com/hc/en-us/articles/201579195

"A NOTE ON FAIR USE: You might be able to incorporate someone else's copyright or trademark into your own work, if you do it in such a way that that is considered "fair use" or in such a way that qualifies as another permissible use. However, please be aware that “fair use” typically applies in limited circumstances and isn’t the same as “freedom of speech”. Quite frankly “fair use” is a difficult concept, even for the experts, and the scope of “fair use” is different in different countries. So even if you think you’ve created a work covered by “fair use” or another permissible use, you should talk to an attorney prior to using it in connection with the Redbubble service. While some uses might appear “fair” or permissible to you, we ask that you understand that Redbubble must act in accordance with its Notice and Takedown procedure when a report has been received. Additionally, certain works may be taken down without a specific report being received if we are otherwise alerted or aware of potential infringement issues.

Ultimately, you take full responsibility for the works you upload and display on Redbubble. This is reflected in the Redbubble User Agreement. Use of the Redbubble website indicates continued acceptance of this Agreement.

So please do us all a favour and if someone has created or owns the rights to a picture, painting, photograph, logo, story, poem or any other work, copyright, trademark or publicity right (regardless of whether it’s an individual or a large global company), obtain consent before you use that work in connection with the Redbubble service. This will help ensure that you don’t infringe the rights of any third party and help us promote an encouraging and inspired environment at Redbubble filled with wit, soul, meaning and aesthetic genius."

The last paragraph here assumes that deigners have obtained permission (so Redbubble doesn't have to).  You'd reasonably assume that most people don't bother.  The sheer amount of designs available seems to imply that R* isn't agressively chasing down copyright infringments.

I was thinking the site URL to help promote the site but if this is a conflict of interest with R*, then it could be left out.

Hi all, yes we definitely couldn't use any part of the official Red Dead Redemption 2 logo or anything like that - it's all Rockstar's IP, including the words.

That's why said it might have to be our own cowboy emblem only.

Most of you have pointed out too, while the URL would be nice (maybe to promote the site), even that might be iffy and it's a path I'd rather not go down TBH.

The logo on a shirt would be awesome.
